ENGAGEMENT LETTER, SUBSTANTIATION & ELD 2023


Purpose

  • This letter is to confirm the terms of engagement between yourself and SJ Ellis Accounting Services and the nature and limitations of the services that we provide.

This is a legal agreement. Please be aware of the terms and conditions and compensation owed if you break this engagement.

 

Scope and Period of the Engagement

This Terms of Engagement for Public Accounting Services (TE) confirms the engagement and the nature and limitations of services provided.

  • This engagement includes the preparation and lodgement of your personal tax return, accompanied with a copy of your Income Tax Return Tax Estimate Summary for the financial year under engagement.
  • We will provide you with professional accounting services in compliance with APES Standard 110 Code of Ethics (Code), taxation services in accordance with APES Standard 220 Taxation Services and the Code of Professional Conduct pursuant to Tax Agent Services Act 2009.
  • Unless otherwise specified in this TE or letter of engagement, audit and assurance or review are not included in this engagement.  This engagement doesn’t include accountant letters or references requested by lenders, financiers, real estate agents or government institutions. 
  • This TE will commence at the time you indicate acceptance and will continue until revoked by us or you.

 

Fees
The fee arrangement is based on the expected amount of time and the level of staff required to complete the tax return as agreed.

Basic Tax Return (TR) $159,  Advanced TR Deduction and Rental $229

  • We have allocated 30 minutes time for the preparation of your basic tax return. If the tax return cannot be completed within the allocated time an additional fee of $65 per hour will be charged
  • If no method is specified, our fees will be calculated on a time-cost basis at a rate of $140 per hour.
  • Unless other payment terms are agreed, each invoice is payable within 7 days of receipt.
  • Please note we expect payment before Lodgement and we do not take fee from refund.
  • We will charge interest on late accounts at a rate of 7%p.a.
  • You are responsible for all recovery costs associated with the collection of your debt with us
  • Our invoices may also include disbursements paid by us. These may include photocopying charges, ATO correspondence, telephone and facsimile transmission charges, travel fares and expenses, stamp duty and fees paid to third parties such as couriers, registration fees or fees for other professionals. These may be in addition to the fixed price (if applicable).

Third Party Involvement

  • We may from time to time engage third party specialist professionals and other public practitioners, where warranted, to obtain the advice you need or to assist us to provide our service to you. These may include cloud service providers and outsourced service providers.
  • We will seek your consent if third party involvement is likely to exceed the fixed price (if applicable).
  • We have outsourcing arrangements with BOSS in Bangalore, India, whom we engage from time to time to assist us. The nature and extent of the services that we utilise are as follows: accounting services, individual tax returns, bookkeeping services, business accounting, preparation of company returns and financials.  In providing our services to you, we utilise BOSS using Cloud Computing
  • Thura Pty Ltd Services is an authorised representative of Lifespan 1272789 which is the preferred provider of financial planning services for S J Ellis Accounting Services. SJ Ellis accounting services does not provide financial planning advice but due to client demand it has been necessary to create our own financial planning business (Thura Pty Ltd). If you choose to utilise Thura’s service, a fee for service will be received by Thura and by signing this document you authorise the transfer of information between
    both SJ Ellis Accounting Service and Thura Pty Ltd.

ELECTRONIC LODGMENT DECLARATION

This electronic lodgement declaration authorises S.J. Ellis Accounting Services to lodge the 2023 tax return on my behalf

Electronic Lodgment Declaration (Form I) PART A
This declaration is to be completed where a taxpayer elects to use an approved ATO electronic channel. It is the responsibility of the taxpayer to retain this declaration for a period of five years after the declaration is made, penalties may apply for failure to do so.

Privacy
The ATO is authorised by the Taxation Administration Act 1953 to request your tax file number (TFN). We will use your TFN to identify you in our records. It is not an offence not to provide your TFN. However, you cannot lodge your income tax form electronically if you do not quote your TFN.

Taxation law authorises the ATO to collect information and to disclose it to other government agencies. For information about your privacy go to ato.gov.au/privacy

Electronic funds transfer – direct debit
Where you have requested an EFT direct debit some of your details will be provided to your financial institution and the Tax Office’s sponsor bank to facilitate the payment of your taxation liability from your nominated account.

Declaration
I declare that:
the information provided to my registered tax agent for the preparation of this tax return, including any applicable schedules is true and correct, and the agent is authorised to lodge this tax return.
Important: The tax law imposes heavy penalties for giving false or misleading information.

PART B Electronic funds transfer consent
This declaration is to be completed when an electronic funds transfer (EFT) of a refund is requested and the tax return is being lodged through an approved ATO electronic lodgment channel.

The declaration must be signed by the taxpayer prior to the EFT details being transmitted to the Tax Office. If you elect for an EFT, all details below must be completed.

Important: Care should be taken when completing EFT details as the payment of any refund will be made to the account specified.
